1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Formetrix application and related services ("Service") provided by AEV Labs.
By downloading, installing, or using Formetrix, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Non-Medical Disclaimer
Formetrix is designed for fitness and wellness tracking only. It does not provide medical advice, diagnosis, or treatment and is not a substitute for professional medical care.
Always consult a physician or qualified healthcare provider before making significant changes to your diet, exercise routine, or health regimen. You understand and agree that you use the Service at your own risk.
3. User Accounts
To use certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate and up-to-date information
- Maintain the confidentiality of your login credentials
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or pose security risks.
4. User Content
"User Content" includes any information you submit to the Service, such as measurements, photos, notes, and other fitness-related data.
You retain ownership of your User Content. By using the Service, you grant AEV Labs a limited, non-exclusive, revocable license to process and display your User Content solely for the purpose of providing and improving the Service.
We do not claim ownership over your User Content and do not use it for advertising or training external AI models.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any law
- Reverse-engineer, decompile, or attempt to obtain the source code of the App
- Interfere with or disrupt servers, networks, or security features
- Upload content that is unlawful, harmful, abusive, or invasive of others' privacy
- Attempt unauthorized access to other user accounts or data
We may take appropriate action, including suspension or termination of access, in response to violations of this section.
6. Payments & Subscriptions (Future)
Formetrix may offer paid features or subscriptions in the future. Any fees, billing cycles, and cancellation policies will be clearly communicated before you commit to a purchase.
In the event of a future subscription, applicable app store terms (such as Apple App Store or Google Play) may also govern billing and refunds.
7. Availability & Data Loss
We strive to keep the Service available and reliable but cannot guarantee uninterrupted or error-free operation. Planned maintenance, technical issues, or factors outside our control may result in temporary unavailability.
While we use reputable infrastructure providers and implement safeguards, data loss can occur in rare cases. We encourage you to periodically export or back up your important data.
To the fullest extent permitted by law, AEV Labs is not liable for any losses resulting from Service interruptions, data loss, or technical issues.
8. Termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have:
- Violated these Terms
- Engaged in fraudulent or abusive behavior
- Posed a security or legal risk
You may stop using the Service at any time. You may also request deletion of your account and associated data as described in our Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
AEV Labs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.
Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you in full.
10. Governing Law
These Terms are governed by and interpreted in accordance with the laws and consumer protection regulations applicable in your country of residence, to the extent required by mandatory local law.
In all other cases, the governing law shall be the laws of a neutral and internationally recognized jurisdiction, without regard to conflict-of-law principles.
Any disputes arising from or relating to these Terms may be brought before the courts of your country of residence where required by mandatory local law, or otherwise before the courts of a neutral jurisdiction.
